Introduction

Eye-Fi takes the protection of your privacy seriously. Eye-Fi is committed to protecting the confidentiality of your personal information and the content of your photos, according to your sharing preferences.

This document describes our policy regarding privacy protection, and identifies information sharing requirements and security measures taken by Eye-Fi. This policy applies to all of the products, services and websites offered by Eye-Fi, Inc.

We may from time-to-time revise this Privacy Policy, and the date of last revision will be available at the top of this page, so please be sure to check back periodically. By visiting the Eye-Fi website and/or Eye-Fi Manager/Center/Helper Applications, you are acknowledging and accepting this Privacy Policy. Your continued use of the website after changes have been posted to the Privacy Policy will constitute your acceptance of such changes.

Information We Collect

Personal information is information that others can use to identify you, such as your name, address, email address, social security number, credit card number or phone number. Eye-Fi requires that you submit the following personal information when creating an Eye-Fi account and activating an Eye-Fi Card: your name and valid email address.

When you use your Eye-Fi Card to upload pictures to a website, it communicates with the Eye-Fi Service to facilitate the process. When your Eye-Fi Card uploads your photos in this manner, Eye-Fi may store your photos and information about the photos including photo file size, date and other metadata that may be part of the exchangeable image file format (EXIF). When you use the Eye-Fi Card to upload pictures only to your computer, information about your photos and upload activity is not sent to or recorded by Eye-Fi.

Whether or not you create an Eye-Fi account or activate an Eye-Fi Card, Eye-Fi servers automatically record information sent by your browser when you use the Eye-Fi Manager/Center/Helper or visit Eye-Fi websites, including Internet Protocol address, browser type and language, and date and time of request. We may also collect information using cookies, web beacons or similar technologies.
When you send email or other communication to Eye-Fi, we may retain those communications in order to process your inquiries, respond to your requests and improve our service.

How Your Information is Used

  • Eye-Fi may use your personal information for the following reasons:
  • To provide you with personalized content;
  • To process and respond to inquiries;
  • For the purposes for which you provided the information;
  • To maintain or improve the website and services;
  • To alert you to new features, special events, products and services;
  • To enforce the Terms and Conditions;

 

In the future, we may sell some or all or our assets. In such transactions, customer information generally is one of the transferred business assets. In the event of a sale of our assets including our database, customer information will be transferred. We will require buyers to honor our Privacy Policy.

Information Eye-Fi receives through its relationships with other companies and websites may be combined with the information we collect and will be treated in accordance with this Privacy Policy.

When your Information is Shared

Eye-Fi may disclose your personal information to another entity (i) for purposes of outsourcing one or more of the functions described above; (ii) to confirm or update information provided by you; (iii) to inform you of important information; and/or (iv) as a part of a sale of assets as described above. We may also share your information in response to a subpoena, legal order or official request, when we believe you have acted in violation of the Terms and Conditions, or when we believe that doing so may protect your safety or the safety of others. Finally, Eye-fi may share your personal information with third parties for marketing purposes only when Eye-Fi has obtained your opt-in consent.

Information that contains no personally identifiable information, e.g., deidentified aggregate data, may be shared with third parties or used for any reason.

If you elect to use the Eye-Fi Service to share photos online, Eye-Fi may provide select personal information, such as log-in information, to your chosen destination website as required in order to deliver your pictures. If you choose to share your pictures online, Eye-Fi may transmit photo metadata to your chosen destination website to enable features or services.

How Your Information is Protected, Maintained and Deleted

Eye-Fi attempts to protect against the loss, misuse and alteration of your pictures and your personal information. Our servers and systems are protected by reasonable physical and electronic security measures.

You may delete your Eye-Fi account at your discretion through the Eye-Fi Manager website or the Eye-Fi Center application; provided, however, that requests to delete content and information are subject to Eye-Fi’s internal reporting and retention policies and all applicable legal obligations.

How We Use Cookies

A cookie is a small data file that can be placed on your hard drive when you visit certain websites.

When you use the Eye-Fi Service or visit Eye-Fi websites, Eye-Fi sends one or more cookies to your computer that uniquely identifies your Internet browser. We use cookies to collect, store and sometimes track information for statistical purposes to improve the services we provide. If you are a registered user, we will use a cookie to save your settings and to provide customizable and personalized services. Additionally, be aware that if you visit other websites you may be required to accept cookies. Advertisers and partners may also use their own cookies. We do not control use of these cookies and expressly disclaim responsibility for information collected through them.

From time to time Eye-Fi will merchandise its products with the use of top tier internet based advertising companies. These companies will use cookies to help target what products and services should be marketed to you. Eye-Fi provides the following “opt out” links for excluding yourself from these forms of marketing.

Application of This Privacy Policy

This Privacy Policy applies to websites and services that are owned and operated by Eye-Fi, Inc. Eye-Fi does not exercise control over the websites to which you may distribute your photos. These other sites may place their own cookies or other files on your computer, collect data or solicit personal information from you.

Eye-Fi processes personal information on servers in the United States of America. In some cases, Eye-Fi may process your personal information on a server outside your own country.
